By purchasing a plan, accessing or using the Homegrown Hustle and any related services or tools (collectively, “Services”) you (“you”, “User”, “Business Owner”, or “Client”) agree to be bound by this Agreement and every policy referenced herein (including our Privacy Policy and Cookie Policy). If you do not agree, do not use the Services.

1. Who We Are:

Homegrown Hustle Inc. (“HH”, “we”, “our”, “platform”) is a Canadian company headquartered in Calgary, Alberta. We operate a hyper-local online business directory that helps Users discover, support, and connect with small and home-grown businesses in Calgary and beyond.

2. Eligibility & Age Restrictions:

• 13–17 years: Use the Services only with the consent and direct supervision of a parent or legal guardian.

• Under 13: Do not use the Services.
  By using the Site, you represent that you meet the applicable age requirements and that all registration information you submit is truthful and accurate.

3. Scope of Permitted Use

You receive a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Site for the following purposes:

• Browsing or searching for businesses.

• Submitting or managing your business listing(s).

• Communicating with HH or listed businesses via forms, email links, or other features.
  
  

You must not (and must not attempt to):

• 3.1 Access the Site via automated means (bots, scrapers, crawlers) without our prior written consent.
  3.2 Reverse engineer, decompile, or otherwise attempt to derive the source code of any portion of the Site.
  3.3 Copy, reproduce, sell, resell, or exploit any portion of the Site or its content for commercial purposes except as expressly permitted.
  3.4 Harvest or collect personal data of other Users without consent.
  3.5 Submit false, misleading, defamatory, or infringing content.
  3.6 Interfere with or compromise the integrity, security, or performance of our networks or systems.
  
  
  

4. Business Listings & Paid Plans

Detailed pricing and features are displayed on the pricing page and may be updated from time to time at HH’s sole discretion.

4.1 Business Listings & Paid Plans

The "Growth" Plan is offered at CAD $30/month. Pricing and features may be updated from time to time at HH's sole discretion.

4.2 Payment Authorisation & Renewals

By purchasing any paid listing, you authorise HH (via Stripe, its payment processor) to automatically bill the payment method on file on the schedule you select (monthly or annual). Recurring charges continue until cancelled in accordance with Section 4.3.

4.3 Cancellations

• You may cancel your paid listing at any time by contacting us at Homegrownhustle25@gmail.com

• Notice Requirement: Cancellations must be received at least 14 days before the next billing date to avoid being charged for the following month.

• Once a billing cycle has begun, fees for that cycle are non-refundable, except where required by Canadian consumer protection law.

4.4 Right to Modify or Remove Listings

HH may edit, suspend, or remove any listing that:

• Violates these Terms.

• Contains inaccurate, misleading, or infringing content.

• It is deemed inappropriate for a family-friendly local directory.

Taxes: Applicable GST/HST/PST will be added where required by law.

5. Accounts, Passwords & Security

Creating an account may be required to manage listings or access certain features.
You are responsible for:

Safeguarding your login credentials.

promptly notifying HH of unauthorised use.

ensuring all information provided remains current and accurate.

HH disclaims liability for losses caused by unauthorised account access resulting from your failure to safeguard credentials.

6. Intellectual Property

All trademarks, service marks, and trade names displayed on the Site belong to their respective owners. Unauthorised use is prohibited.

7. Privacy & Data Collection

Our Privacy Policy (homegrownhustle.ca/privacy) outlines what data we collect (e.g., names, email addresses, phone numbers, and analytics cookies) and how we use, share, and protect it. By using the Services, you acknowledge and consent to those data practices.

8. Electronic Communications Consent

When you visit the Site, create an account, list a business, or email us, you consent to receive communications from us electronically. You agree that electronic notices, disclosures, and other messages satisfy any legal requirement that such communications be in writing. You may opt out of marketing emails at any time via the unsubscribe link or by contacting us.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HH DISCLAIMS ALL WARRANTIES (EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE) INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, OR GOODWILL; OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE USE (OR INABILITY TO USE) THE SERVICES, EVEN IF HH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HH’s total cumulative liability shall not exceed the greater of (i) CAD $100 or (ii) the fees you paid HH in the 12 months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless HH and its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

Your breach of these Terms.

Your content or listings.

Your violation of any third-party rights or applicable laws.

12. Dispute Resolution & Governing Law

Good-Faith Mediation: Before initiating litigation, the parties shall first attempt to resolve disputes informally and, if necessary, through mediation in Calgary, Alberta.

Jurisdiction: This Agreement is governed by the laws of the Province of Alberta and the federal laws of Canada. The provincial and federal courts located in Calgary have exclusive jurisdiction over any dispute not resolved informally.

13. Changes to the Terms

We may revise these Terms at any time. The “Effective Date” will indicate the latest version. Continued use of the Services constitutes acceptance of the revised Terms. Material changes will be announced via the Site or email, where practical.

14. Miscellaneous

By completing a purchase through Stripe or otherwise accessing/using the Services, you acknowledge and agree that:

• Your purchase constitutes electronic acceptance of this Agreement
